Terms of Service
Effective date: January 1, 2025
Welcome to Leksa (the "App"). These Terms of Service (the "Terms") form a legally binding agreement between you ("you" or "User") and Allsidium AS ("Company," "we," "us," or "our") governing your access to and use of the App and any services we provide through it.
By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the App.
1. Who May Use the App
The App is rated 4+ on the App Store and its content is suitable for all ages. However, if you are younger than the age at which you can lawfully enter into a contract in your jurisdiction (13 years in the United States or the applicable "digital consent" age where you live), you must have a parent or legal guardian review and agree to these Terms and supervise your use of the App.
2. License Grant
Subject to your continued compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to download and use one copy of the App on each Apple-branded device that you own or control, solely for your personal, non-commercial reading assistance purposes.
2.1 Your Content
The App processes images and text that you provide (collectively, "Your Content") to convert images to text using optical character recognition (OCR) and provide text-to-speech functionality.
Ownership: You retain all rights, title, and interest in and to Your Content. We do not claim ownership of any images, text, or documents you process through the App.
Processing: Your Content may be processed by third-party services (including OpenAI's API for text cleanup) to improve the reading experience. We only use Your Content to provide the App's functionality and do not store or use it for any other purpose.
2.2 App Ownership
All rights, title, and interest in and to the App, including all intellectual-property rights, are and will remain our exclusive property and that of our licensors. These Terms do not grant you any ownership rights in the App.
3. Subscriptions and Payments
The App offers a freemium model with optional auto-renewable subscriptions for premium features.
- Free Features: Basic text scanning and reading with limited text length.
- Premium Features: Full-length document scanning, additional voices, print functionality, and enhanced features.
- Billing: Payment will be charged to your Apple ID at confirmation of purchase and on renewal.
- Auto-Renewal: Your subscription renews automatically unless canceled at least 24 hours before the end of the current period.
- Management: Manage or cancel subscriptions in Settings > Apple ID > Subscriptions.
- Refunds: Refunds are handled by Apple according to App Store policy.
4. Acceptable Use
You agree not to:
- Use the App to process copyrighted material that you do not have the right to use
- Reverse-engineer, decompile, or disassemble the App
- Use the App for any unlawful, harmful, or inappropriate purposes
- Attempt to bypass any security measures or access restrictions
- Use the App in a way that could damage, disable, or impair our services
We may suspend or terminate your access for violations of these terms.
5. Privacy and Data Handling
Our Privacy Policy explains what personal data we collect, how we process it, and your rights regarding your data. By using the App, you consent to those practices.
6. Disclaimers
- OCR Accuracy: While we strive for accuracy, optical character recognition may contain errors. Users should review converted text for accuracy.
- Educational Tool: The App is designed as a reading assistance tool and is not a substitute for professional educational or medical advice.
- No Medical Claims: We make no medical claims about treating dyslexia or other reading conditions.
- Warranty Disclaimer: To the maximum extent permitted by law, the App is provided "AS IS" without warranties of any kind.
7. Limitation of Liability
To the fullest extent permitted by applicable law, we will not be liable for any indirect, special, incidental, consequential, or punitive damages, or any loss of profits or data, arising out of or in connection with the App or these Terms. Our aggregate liability shall not exceed the amount you paid for any subscription during the 12 months preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless Allsidium AS, its officers, employees, agents, and licensors from and against any claims, losses, liabilities, damages, and expenses arising out of your use or misuse of the App or violation of these Terms.
9. Termination
We may terminate or suspend your access to the App at any time for conduct that we reasonably believe violates these Terms. Upon termination, your right to use the App ceases immediately.
10. Governing Law
These Terms are governed by the laws of Norway, excluding its conflict-of-law rules. Any dispute arising out of these Terms shall be resolved in the courts of Norway, unless otherwise required by applicable consumer protection laws.
11. Changes to Terms
We may update these Terms from time to time. We will notify users of any material changes through the App or other reasonable means. Continued use of the App after the effective date constitutes acceptance of the updated Terms.
